The 1850 census for Beat Number 8 in Butler County, Alabama shows Benjamin Newton to be a teacher and 44 years old. This census was taken 28 November 1850. Another census for Beat Number 1 in Butler County, Alabama shows Benjamin Newton to be a farmer with $300 real estate holdings and to be 42 years old. This census was taken 29 September 1850. These two recordings are for the same person since the wife and children are all the same. I think the the September census was given by Benjamin since the ages appear to be more accurate than those on the later census record. In addition, the November census record shows Benjamin as "B eny" and Eliza Jane as "Jane" whereas the September census sho ws Benjamin as "Benjamin" and Eliza Jane as "Eliza."

The state of Alabama, Butler County. Know all men by these present that we Benjamin Newton, Hugh McCane and Nathaniel J. Robenson of the county and state aforesaid are held and firmly bound unto S. J. Bolling, Judge of the Probate Court of said county and his successors in office in the penal sum of two thousand dollars for which payment will and truly to be made and have bound ourselves, our heirs, our executors, and administrators jointly and singlely firmly by these present, sealed with our seals and dated this 22nd day of September A.D. Eighteen Hundred and Sixty-three. The condition of the above obligation is such that whereas the above bound Benjamin Newton has been appointed administrator of the estate of Eliza J. Newton, deceased, now if the said Benjamin Newton shall well and truly perform all the duties which are or maybe by law requested of him as such administrator then the above obligation to be void, otherwise to remain in full force.

Heighsmith and Mary Goodson, childred of said Melinda Melvina Goodson, deceased, the following described tract or parcel of lad, viz: the south east quarter of north west quarter and the north east quarter of south west quarter of section 22, township 9, range 15, containing 80 acres more or less, situated, lying and being in the county of Butler and State of Alabama, to have and to hold the same unto the said Sarah Jane Pryor, Emma J. Heighsmith and Mary Goodson jointly, their heirs, executors, administrators and assigns forever in fee simple, and we hereby covenant with the said Sarah Jane Pryor, Emma J. James Sidney Newton

James was with the 14th Alabama, Company F. He was wounded during the Battle of Fredericksburg and died wounds. It is thought that he enlisted with the 8th or 9th Alabama and was integrated into the 14th when the these units came under a unified command. No detailed record of his service has been found.

This was Benjamin's second wife. Mary was the daughter of Asa Ernest and Tabitha ????. In the 1880 census, Tabitha is living with Benjamin and Mary. She married M. M. Elder, who worked at a saw mill in Autuaga County, Alabama. He was killed shortly after 1860.
In some papers Mary's middle name is shown with the initial "M", but I have not been able to find any reference where the middle name is spelled out.
